Weight change during production - labeling rules

I have a question about the label weight declaration.
I have a product that is 100g, and 50g of mushrooms are used in the production according to the recipe. The mushrooms are diced, put in a can, given a brine and sterilized. During the heat treatment the mushrooms absorb a significant amount of the brine (about 20%). At the end of the heat treatment the net weight remains unchanged but the mushrooms' drained weight is 60 g.
When listing the ingredients on the label, what is legally (European Union) correct? 
 
50% mushroom, water, salt, spices or
60% mushroom, water, salt, spices?
 
How can I address this in the product specifications? Does the customer need to know about this weight change during the technology?

REGULATION (EU) No 1169/2011 Article 18

 

"

List of ingredients

1.  
The list of ingredients shall be headed or preceded by a suitable heading which consists of or includes the word ‘ingredients’. It shall include all the ingredients of the food, in descending order of weight, as recorded at the time of their use in the manufacture of the food.
2.  
Ingredients shall be designated by their specific name, where applicable, in accordance with the rules laid down in Article 17 and in Annex VI.
3.  
All ingredients present in the form of engineered nanomaterials shall be clearly indicated in the list of ingredients. The names of such ingredients shall be followed by the word ‘nano’ in brackets.
4.  
Technical rules for applying paragraphs 1 and 2 of this Article are laid down in Annex VII."

Hi sztamas,

You do not need to give a QUID if the ingredients:

  • have only been used in small quantities as flavouring
  • are used in varying proportions and can be labelled as fruit, vegetables, mushrooms, herbs or spices (such as in a vegetable soup)
  • already have a quantity shown on the label as a ‘drained net weight’.

As per customers requirement, you should declare as 50% mushrooms as the quantity. customer doesn't need to know. in case if they do query, you can give an explanation.
